Returns, complaints and withdrawal

A natural person purchasing outside their trade, business or professional activity may withdraw from a distance contract without giving a reason within 14 days.

For the purchase of goods, the 14-day period generally begins when the customer or a designated third person other than the carrier receives the goods.

The customer must send an unambiguous statement before the 14-day period expires. The online withdrawal function can be used for this purpose. A reason does not have to be provided.

After submitting the withdrawal statement, the customer must return the goods without undue delay and no later than 14 days after notifying us of the withdrawal.

The direct cost of returning the goods is borne by the customer unless FUNDUS-SPORT d.o.o. expressly agrees otherwise.

The customer may handle the goods only to the extent necessary to establish their nature, characteristics and functionality. The customer may be responsible for any diminished value caused by handling beyond that extent.

Opening the packaging does not by itself remove the right of withdrawal. Where possible, the product should be returned with its original packaging, labels, accessories and documentation because missing or damaged parts may affect its value.

The refund will be made without undue delay and, where required by law, no later than 14 days after we receive the withdrawal statement.

For a sales contract, the refund may be withheld until the goods have been returned or until the customer supplies evidence that the goods were sent back, whichever occurs first.

The refund is made using the same payment method used for the original transaction, unless another method is expressly agreed and does not cause additional costs to the customer.

• Products made according to the customer’s specifications.
• Products clearly personalized for the customer, including requested names, numbers, initials, crests or special prints.
• Other products for which the right of withdrawal is excluded by mandatory law.

A standard club product held in stock is not excluded solely because it carries a club design. The exclusion applies when the particular item is made or clearly customized according to the customer’s individual request.

The 14-day withdrawal procedure is not the same as a complaint concerning a damaged, incorrect, defective or non-conforming product. Statutory rights relating to non-conformity remain applicable independently of the withdrawal right.
